TERMS OF SERVICE

OVERVIEW

This website is operated by Lumen Mobility, a trading name of Cinque Ports Mobility Limited (“we”, “us”, “our”).

Cinque Ports Mobility Limited offers this website, including all information, tools, and services available from this site, subject to your acceptance of the terms, conditions, policies, and notices set out below.

By visiting our site and/or purchasing products or services from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), together with our Privacy Policy and Refund & Returns Policy, which form part of this agreement.

If you do not agree to these Terms, you must not access the website or use our services.

SECTION 1 – ELIGIBILITY & USE OF THE WEBSITE

By using this website, you confirm that you are at least 18 years old and legally capable of entering into a binding contract.

You must not use the website or our services for any unlawful purpose, or in any way that breaches applicable laws or regulations.

You must not introduce viruses, malicious code, or any material intended to disrupt the operation of the website or associated systems.

We reserve the right to suspend or terminate access to the website or services where these Terms are breached.

SECTION 2 – OUR SERVICES & ASSESSMENT-LED SALES

Lumen Mobility supplies mobility, rehabilitation, and assistive products, many of which:

  • Require professional assessment or demonstration

  • Are configured, adapted, or selected based on individual needs

  • May be prescriptive, bespoke, or made to measure

Information on this website is provided for general guidance only. Product descriptions, images, and prices do not constitute a guarantee of suitability.

Final recommendations, specifications, and pricing may depend on an assessment, demonstration, or further consultation.

We reserve the right to decline supply where we believe a product is unsuitable or inappropriate.

SECTION 3 – IN-HOME DEMONSTRATIONS & ASSESSMENTS

Where products are supplied following an in-home demonstration, trial, or assessment, this will normally constitute an opportunity for you to inspect and determine suitability before purchase.

As a result:

  • The statutory 14-day cancellation right under the Consumer Contracts Regulations may not apply

  • This is particularly relevant for prescriptive, bespoke, or configured products

Where manufacture, configuration, or ordering has begun following an assessment, cancellation rights may be excluded. This will be explained clearly at the point of sale.

SECTION 4 – ORDERS, PRICING & PAYMENT

All prices are subject to change without notice.

Orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order, including where:

  • Pricing errors occur

  • Products are unavailable

  • We reasonably believe the product is unsuitable

If an order is cancelled, any payment taken will be refunded.

You agree to provide accurate, complete, and up-to-date billing and contact information.

SECTION 5 – DELIVERY, COLLECTION & RISK

Delivery dates are estimates only and not guaranteed.

Risk in goods passes to you upon delivery or collection, except where goods are faulty or incorrectly supplied.

You are responsible for ensuring safe and suitable access for delivery and collection.

SECTION 6 – RETURNS, CANCELLATIONS & REFUNDS

Returns, cancellations, and refunds are governed by our Refund & Returns Policy, which forms part of these Terms.

In summary:

  • Distance-sale cancellation rights apply only where you have not had an opportunity to try the product

  • Prescriptive, bespoke, assessed, or made-to-measure products are non-returnable, unless otherwise agreed

  • Faulty or incorrectly supplied goods are handled in line with your statutory rights

Nothing in these Terms limits your rights under the Consumer Rights Act 2015.

SECTION 7 – FAULTS, MANUFACTURERS & REMEDIES

Where a product is faulty or incorrectly supplied, we may require the manufacturer to inspect or rectify the issue before replacement or refund is considered.

This does not affect your statutory rights.

SECTION 8 – THIRD-PARTY TOOLS & LINKS

The website may include links to third-party websites or tools. We are not responsible for their content, accuracy, or policies.

Use of third-party services is at your own risk.

SECTION 9 – USER SUBMISSIONS & FEEDBACK

Any feedback, suggestions, or materials you provide may be used by us without restriction or compensation.

You must not submit content that is unlawful, defamatory, abusive, misleading, or infringes third-party rights.

SECTION 10 – PERSONAL INFORMATION

Your submission of personal information is governed by our Privacy Policy.

SECTION 11 – WEBSITE ACCURACY & CHANGES

We do not guarantee that website content will always be accurate, complete, or current.

We may update, amend, or remove content at any time without notice.

SECTION 12 – PROHIBITED USES

You must not use the website or services to:

  • Break the law

  • Infringe intellectual property rights

  • Harass, abuse, or discriminate against others

  • Collect or misuse personal data

  • Interfere with security or functionality

We may terminate access for prohibited use.

SECTION 13 – DISCLAIMERS & LIMITATION OF LIABILITY

The website and services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we exclude all warranties not expressly stated.

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence

  • Fraud or fraudulent misrepresentation

  • Any matter that cannot be excluded under UK law

Your statutory rights are not affected.

SECTION 14 – INDEMNITY

You agree to indemnify and hold harmless Cinque Ports Mobility Limited, its directors, employees, and agents against any claims arising from your breach of these Terms or misuse of the website.

SECTION 15 – SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force.

SECTION 16 – TERMINATION

These Terms remain in effect unless terminated by you or us.

We may terminate access immediately where these Terms are breached.

SECTION 17 – ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Refund & Returns Policy, constitute the entire agreement between you and us.

SECTION 18 – GOVERNING LAW
